Terms and Conditions

Promotion Name: “12-Month Build Time Guarantee – SA”

Promoter/Builder: La Vida Australia Pty Ltd (ABN 36 645 789 993), trading as La Vida Homes SA (BLD 324482), of 19-21 Beulah Road, Norwood, SA 5067.

Guarantee Overview:

To qualify for the 12-Month Build Time Guarantee, all the following conditions must be met:

  • The build duration is measured from slab down to Practical Completion Inspection (PCI).
  • The home must be one of La Vida Homes’ standard single storey designs.
  • Selections must be of a standard nature.
  • The site must be a street-facing block in a Greenfield Estate within the Adelaide outer-metropolitan area or be an agreed location by La Vida Homes.
  • The block must not:
    • Be a brownfield, subdivision, hammerhead, or strata lot.
    • Require retaining walls.
  • The block must have all services installed and commissioned.
  • All progress claims must be paid on time, in accordance with the HIA contract terms.
  • All client obligations under the contract must be fulfilled.

Guarantee Commitment:

If the above conditions are met, La Vida Homes SA guarantees to complete construction and hand over the home within 365 days (12 months) from slab down to PCI.

Extensions of Time:

La Vida Homes reserves the right to extend the build period in accordance with HIA Contract – Section 11 and 11.3.

Delays may include (but are not limited to):

  • Inclement weather.
  • Restricted access to site
  • Restricted access to building materials
  • Natural disasters (earthquake, flooding)
  • Accidents (for example fire or explosion)
  • Vandalism or damage beyond builder control.
  • Construction shutdowns due to pandemic events and industrial disputes
  • Delays by service providers
  • Disputes with neighbours
  • Local or statutory authority reasons
  • Christmas shutdown period.
  • Other unforeseen events beyond builder control.


Compensation Terms:

If La Vida Homes SA fails to complete the build within the guaranteed period (excluding approved extensions), the client will receive $400 per week for each week overdue, up to a maximum of 12 weeks. Payments will be made to the client’s nominated bank account.

Additional Conditions:

  • This promotional offer is ongoing and may be varied or withdrawn at any time prior to PPA signing.
  • For clients who have already signed a PPA or building contract, the 12-Month Build Time Guarantee will remain as originally agreed at the time of signing.
  • Compensation is void if:
    • The client breaches any clause of the signed HIA contract.
    • Progress payments are not made in accordance with the contract terms.
    • Or in the event any other terms of the 12-month build time guarantee aren’t met; this is at the discretion of the builder.
